Duty of Care

Section 34 of The Environmental Protection Act 1990 “imposes a duty of care on persons concerned with controlled waste. The duty applies to any person who produces, imports, carries, keeps, treats or disposes of controlled waste, or as a broker has control of such waste. Breach of the duty of care is an offence, with a penalty of an unlimited fine if convicted on indictment”

In summary the Duty of Care says that you must take all reasonable steps to keep your waste safe and that if you give your waste to someone that you need to be sure that they are authorized to take it.

I.T.P. have a bespoke Environmental Permit as well as being a registered waste carrier and therefore are an authorised company to be giving your toner and inkjet cartridges or mobile phones to. If I.T.P. collect from you, you will either be on an annual waste agreement or you will be issued with a waste transfer note which is sufficient to for your compliance with the act
